Terms of Service

Effective Date: insert current date

Acceptance of the Terms of Service

These Terms of Service cover all of Future Bridge's digital products and services, from websites to mobile applications (we call this all "Services" for short). It's a legal agreement between you and Future Bridge—that's us. BY USING THE SERVICES, YOU AGREE ON BEHALF OF YOURSELF AND YOUR CHILDREN TO THESE TERMS OF SERVICE. IF YOU DON'T AGREE, DON'T USE THE SERVICES.

Modifications to the Terms of Service and to the Services

We can change these Terms whenever we need to. When we do, the new version goes live right away. It's on you to check back and see what's changed. If you keep using the Services after we update them, that means you accept the changes. The Services themselves can change too. We might add features, remove them, or update content. If something gets restricted or stops working, that's not our responsibility to fix.

Use of the Services

We put security measures in place to protect your information from getting lost or accessed without permission. But your own security matters too. You're responsible for making sure anyone who uses the Services through your connection follows these Terms. All information you give us needs to be true, up to date, and complete. Let us know right away if anything changes. Nothing transmitted over the internet is completely safe. We do our best to protect your information, but we can't promise it won't get intercepted. That risk is on you. We're not responsible if someone gets around our privacy or security measures. You can't do any of this: (a) access stuff you're not supposed to see; (b) break through our security; (c) mess with the service for other people; (d) create fake packet headers; (e) stop us from monitoring what's happening; (f) use bots or automated tools to get into the Services; (g) upload viruses, trojans, worms, or any kind of malicious code; (h) launch denial-of-service attacks; or (i) do anything that interferes with how the Services actually work.

Account Set-up and Subscription Services

Some of the Services need you to create an account with a username and password (we call these "Login Credentials"). You have to be at least 18 years old. You can also sign in through Apple ID or Google if you're using Membership Services. Don't share your Login Credentials with anyone, and you're responsible for whatever happens on your account. We can shut down any account whenever we want. If you want Membership Services, you'll need a subscription. You can buy one directly from Future Bridge, or through the Apple App Store or Google Play Store. Your subscription works on multiple devices. There's a Subscription Fee that depends on how long you sign up for—one month, six months, or a year. We can raise the price, but we'll give you written notice first and it won't kick in until your current period ends. Your subscription renews automatically unless you cancel before that happens. A third-party payment processor handles the charges. By subscribing, you're letting us charge your payment method automatically at the start of each period. If a payment fails, you lose access. You can cancel anytime, and it takes effect at the end of your current period. Until then, you can still use the service. If you bought through Future Bridge, cancel it in "My Account". If you went through an app store, use their built-in subscription management.

Intellectual Property Rights and Ownership

Everything in the Services—all the content, features, and functionality ("Services Content")—belongs to Future Bridge. That includes information, software, code, text, graphics, videos, audio, design, and how everything is arranged. All of it's protected by copyright, trademark, and other intellectual property laws. Any trademarks, logos, product names, designs, images, or slogans you see belong to us or to whoever else owns them. You can't use them without getting permission in writing first. Using them without permission violates our rights and could break federal laws too. You can use the Services only for personal, non-commercial stuff. Don't remove legal notices or modify, copy, distribute, create derivatives from, display, perform, republish, download, or send out any material unless we specifically say you can. Here's what we do allow: temporary caching, reasonable personal downloads and prints as long as you keep the legal notices, and certain things on social media that we've approved. If you break these rules, your rights to use the Services end. You don't own anything here. We keep all rights we haven't given you. Anything else is a breach of these Terms and probably breaks intellectual property laws.

User Submissions and Conditions of Use

We don't ask for confidential stuff through the Services. But if you do send us materials, content, information, or ideas ("User Submissions"), you're saying they're yours, nobody else has rights to them, and you're giving up any moral rights you have. You're giving Future Bridge a license that lasts forever and works worldwide to use what you submit for anything commercial, and we don't owe you money for it. We can delete User Submissions anytime we want. You're promising that when you use the Services and send us User Submissions, you won't break any laws, violate anyone else's terms, or include anything exploitative, obscene, harmful, threatening, abusive, hateful, explicit, pornographic, violent, inflammatory, or discriminatory. Don't use the Services to stalk or exploit people, especially kids. Don't post false or misleading stuff, and don't pretend something is endorsed by someone who didn't actually endorse it.

Enforcement, Suspension, and Termination

We have the right to take action about User Submissions and Terms violations. That includes legal action, getting law enforcement involved, or telling them who you are. We can shut down or suspend your access whenever we want, for any reason. We'll work with law enforcement if they ask. YOU WAIVE YOUR RIGHT TO SUE US AND AGREE TO HOLD US AND OUR PARTNERS HARMLESS FROM ANY CLAIMS THAT COME FROM OUR INVESTIGATIONS OR WORKING WITH LAW ENFORCEMENT.

No Reliance

The stuff in Services Content is just general information. It's not advice you should base decisions on. If you're thinking about doing something based on what's in the Services, get proper advice first. We try to keep Services Content updated and accurate, but we don't guarantee it. We're not making any promises about how correct, complete, or current it is. Using the Services is at your own risk. We're not responsible for how you use it.

Privacy

When you give us information and use the Services, you're agreeing that we can collect it, use it, send it around, and share it the way our Privacy Policy describes. If you don't like that, don't use the Services.

Third-Party Websites

The Services might link to other sites, but we're not responsible for them. We don't make any claims about what's on those sites. You use them at your own risk and have to follow their terms. You can link to the Services as long as you do it fairly and legally without hurting our reputation. Your link shouldn't suggest that we're connected or that we endorse something. Don't frame the Services on another site. We can take away linking permission whenever we feel like it without telling you first. If we find out you're doing unauthorized framing or linking, you need to stop.

Online Purchases

Orders, subscriptions, purchases, and transactions on Future Bridge go through Shopify and Stripe. They have their own terms and policies, and we're not responsible for them. You should look at what they have to say before you buy anything.

Copyright Complaints

We take copyright infringement seriously and we've set up a process for handling complaints. If you think your copyright's been violated, send us a written claim at the email or mailing address below. Your notice needs to have: (1) your signature (or whoever's authorized to act for you); (2) a description of what you created; (3) where we can find the infringing stuff on our site; (4) how to reach you; (5) a statement saying you genuinely believe there's infringement; and (6) a statement that you're telling the truth under penalty of perjury. If someone complains about you and you think they're wrong, you can send a counter-notice with: (1) your signature; (2) which material got taken down; (3) a statement saying it was a mistake or misidentification, under penalty of perjury; and (4) your contact info plus a statement that you agree to jurisdiction in court.

Disclaimer of Warranties

USING THE SERVICES IS AT YOUR OWN RISK. EVERYTHING IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OR CONDITIONS, WHETHER WE STATE THEM DIRECTLY OR YOU HAVE TO IMPLY THEM. THAT INCLUDES MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE'RE NOT MAKING ANY PROMISES THAT THE SERVICES ARE COMPLETE, SECURE, RELIABLE, SUITABLE, ACCURATE, UP TO DATE, OR AVAILABLE. WE DON'T REPRESENT THAT EVERYTHING WILL WORK PERFECTLY, WITHOUT ERRORS, OR UNINTERRUPTED, THAT WE'LL FIX PROBLEMS, OR THAT OUR SERVERS ARE VIRUS-FREE. WE CAN'T GUARANTEE THAT ANYTHING YOU DOWNLOAD IS VIRUS-FREE. YOU'RE THE ONE RESPONSIBLE FOR YOUR COMPUTER, INTERNET CONNECTION, AND DATA SECURITY. WE'RE NOT LIABLE IF YOUR COMPUTER OR DATA GETS INFECTED WITH DENIAL-OF-SERVICE ATTACKS, FLOODS, VIRUSES, TROJANS, WORMS, LOGIC BOMBS, OR ANYTHING ELSE HARMFUL BECAUSE OF THE SERVICES OR SOMETHING YOU DOWNLOADED.

Limitation on Liability

WHERE THE LAW ALLOWS, WE'RE NOT RESPONSIBLE FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES. THAT INCLUDES PERSONAL INJURY, EMOTIONAL DISTRESS, LOST REVENUE, LOST PROFITS, LOST BUSINESS, LOST DATA—WHATEVER CAUSES IT, WHETHER IT'S A BREACH, TORT, OR SOMETHING ELSE, AND EVEN IF WE KNEW IT COULD HAPPEN. WHERE THE LAW ALLOWS, THE TOTAL AMOUNT WE'RE LIABLE FOR BECAUSE OF THE SERVICES OR YOUR INABILITY TO USE THEM WON'T BE MORE THAN WHAT YOU ACTUALLY PAID US IN THE MONTH BEFORE YOUR CLAIM.

Indemnification

You agree to defend us, cover our costs, and keep us harmless from claims, liability, damages, awards, losses, costs, or expenses (including legal fees) that come from you breaking these Terms or using the Services in a way you shouldn't. That includes User Submissions, third-party sites, or using Services Content without permission.

Governing Law and Choice of Forum

These Terms and the Services are governed by Ontario law and Canadian federal law that applies. Choice of law rules don't change this, no matter where you live. Any legal action has to be brought in Ontario courts. Both of us agree to that exclusive jurisdiction and venue. You're giving up any argument that the court doesn't have power over you or that the location is inconvenient. BY AGREEING TO THESE TERMS, YOU GIVE UP YOUR RIGHT TO BRING A CLASS ACTION AGAINST US OR OUR PARTNERS.

Waiver

If we don't enforce something, that doesn't mean we're giving up the right to enforce it later. Doing something partially doesn't stop us from doing it fully next time.

Severability

If any part of these Terms turns out to be invalid, illegal, or unenforceable, it won't affect the rest of the Terms or how they work in other places.

Entire Agreement

These Terms and our Privacy Policy are the complete agreement between us about the Services. They replace anything we said before in writing or verbally.
